Terms & Conditions

Terms of Service and Private Portrait Bookings

1. About these terms

I provide photography through Flo Knoyle Photography Limited, trading as Flo Knoyle Photography. In these terms, “I”, “me” and “my” refer to the company acting through Flo Knoyle and anyone authorised to deliver the agreed services. “You” means the person making the booking or placing the order.

Company number: 17490906. Registered in England and Wales.
Registered office: 15 Woodburn Road, Stoke-on-Trent, ST6 8GB, United Kingdom.
Email: flo@thehorsephotographer.co.uk
Telephone: 07590 894420
Website: https://www.thehorsephotographer.co.uk/

These terms cover website use, private portrait photography and associated digital-image and artwork orders. Workshops, retreats, commercial commissions and House of Knoyle orders have separate service-specific terms supplied before purchase.

I will provide these terms and your booking details in a form you can keep before you commit. Your accepted quote, booking confirmation and any changes we expressly agree in writing form part of our agreement. Information about the service that forms part of your contract is not displaced by a general disclaimer.

These terms do not remove your statutory consumer rights. Existing bookings remain subject to the terms already agreed unless we mutually agree a change.

2. Quotes and what is included

My quote will state the session, included images, chosen extras and artwork, and the applicable price. Prices given to consumers include any applicable taxes. I will confirm travel, accommodation, venue fees and other applicable charges before booking; charges not yet included will be clearly identified.

Completing my Photoshoot Builder or making an enquiry does not reserve a date or oblige you to book.

New quotes are valid for three months from their issue date unless a different period has been expressly agreed. Once you accept the quote and confirm your booking with the £150 deposit, I will hold the quoted prices for your selected session, extras and artwork for two years from your booking date. Availability must still be agreed. Changes to your selections, additional orders and charges not included in the accepted quote will be priced and agreed separately.

I will not retrospectively apply a new price list to your confirmed selections during that price-hold period.

Your session inclusions are those in your accepted quote. My current Unicorn session includes up to one hour, one look using your own clothing, a digital preparation/style guide and two high-resolution digital images. My current Pegasus session includes up to two hours, client wardrobe access, multiple outfit changes, the guide, design consultations as needed, creative concept support and five high-resolution digital images. Any different offer agreed with you will be recorded in writing.

3. Confirming your booking and paying the deposit

A £150 deposit is required to secure your booking. It is a part-payment towards your agreed total, not an additional fee.

Your date is secured once we have agreed the session, date and full quote, you have accepted the booking terms, and I have received the £150 deposit in cleared funds. I will send written confirmation.

If I receive a payment but cannot accept the booking, I will refund that payment. Paying a deposit does not override any statutory cancellation or refund right.

4. Balance payment and instalments

The remaining balance for the session, pre-booked extras, pre-ordered artwork and agreed associated charges must reach me in cleared funds no later than 72 hours before the confirmed shoot start time. I will state the actual deadline in your booking confirmation or invoice.

For a booking accepted less than 72 hours before the shoot, full payment is due when the booking is confirmed.

Payment plans are available by prior agreement. I will confirm the amounts and dates in writing. Unless I expressly agree otherwise in writing, an instalment arrangement does not extend the final 72-hour payment deadline.

Additional photographs or artwork ordered after the shoot are payable separately under the terms confirmed when you place that order. I do not require you to pay for unselected, optional purchases before the shoot.

If the balance is not paid by the agreed deadline, I will not attend or conduct the photoshoot. I will contact you in writing to explain the non-payment and confirm cancellation. I am not required to keep the date available after cancelling the booking.

In these circumstances, your £150 deposit may be forfeited and retained towards the reasonable net losses caused by the cancelled booking, as explained in section 5. This does not permit an automatic or disproportionate penalty.

I will not commence separately ordered artwork production or release additional purchased images until the relevant payment has cleared.

5. Cancellation, missed payments and deposits

Please contact me promptly by email if you need to cancel.

If you cancel, fail to attend, or your booking is cancelled because you have not paid by the agreed deadline, I may retain money already paid, including some or all of the £150 deposit, only to cover reasonable net losses directly caused by that cancellation.

These may include preparation already carried out, irrecoverable supplier commitments and loss of profit on the reserved booking. I will take reasonable steps to reduce those losses and account for costs saved and any replacement booking. I will not recover the same loss twice.

Where my recoverable losses are less than the amount you have paid, I will refund the difference. Where I retain money, I will explain the basis of the deduction. Your deposit is not automatically non-refundable in every circumstance.

This section does not apply to a statutory cancellation where the law requires a different refund, or to cancellation caused by my breach of contract.

6. Rescheduling and weather

If you request a date change at least 48 hours before the shoot, I will work with you to agree an available replacement date and transfer your existing payments, provided payments already due have been made. Any unavoidable additional costs must be explained and agreed before the change is confirmed.

If you request a change with less than 48 hours’ notice, I will consider the circumstances and availability. Cancellation charges, if applicable, will be assessed under section 5. A further deposit may be needed for a replacement booking if the earlier deposit has properly been applied to losses, but I will not charge twice for the same loss.

Please tell me as soon as possible about illness, lameness or any other issue affecting you or your horse. I will discuss safe and practical options with you.

If I decide weather or conditions make the shoot unsafe or unsuitable, I will arrange a mutually agreed replacement date and transfer your payments without a rescheduling fee. I will explain any changes to third-party arrangements before you agree them.

Where a statutory refund right applies, it takes priority over a rescheduling arrangement.

7. If I cannot provide the agreed service

If illness, an emergency or another serious issue prevents me from attending, I will contact you as soon as reasonably possible. We can agree a new date or, with your approval, a suitable replacement photographer.

If I cancel and cannot provide an alternative you accept, I will refund payments for the services and products not provided. I will not retain your deposit as a cancellation charge for my own cancellation.

If an event outside either party’s reasonable control prevents performance, I will discuss rescheduling and any applicable refund. I will not use a blanket “no refunds” rule to remove your rights.

8. Locations, travel and third-party costs

I charge 50p per mile for the total round-trip journey unless your accepted quote states a different arrangement. I will confirm the mileage and total travel charge before you book.

Where accommodation, venue hire, permissions, horses, handlers or other third-party services are needed, I will explain the arrangements and costs before you agree them. Location scouting is a separate service where selected.

If you arrange a location or third-party service yourself, you are responsible for obtaining the necessary permission and giving me relevant access and safety information. A separate agreement you make directly with a third party is subject to that provider’s terms.

I will not add unapproved optional charges to your booking.

9. Preparation, participation and horse welfare

Please give me accurate information about your horse, the people attending, the location, access, behavioural concerns and any relevant safety or accessibility needs.

You must have authority to arrange photography of the horse and any property involved, and permission from the relevant owner or venue. A parent or legal guardian must provide the necessary agreement for a child participating.

You or your agreed competent handler remain responsible for handling and controlling your horse unless our booking expressly provides otherwise. My role as photographer does not replace an owner’s or handler’s responsibility.

I will work with reasonable care and skill. I may adapt, pause or stop an activity that presents an unreasonable safety or welfare risk. I will not require a horse or person to take part in an unsafe activity.

I cannot guarantee a particular expression, pose, behaviour, weather condition or image that depends on factors outside my control. This does not excuse a failure to provide the service we agreed with reasonable care and skill.

Please discuss other photographers, filming or behind-the-scenes recording with me beforehand so these do not disrupt the shoot or create a safety issue.

If you arrive late, the available session time may be reduced where I cannot extend it. If you do not attend, section 5 applies. If a shoot must stop because of a serious breach by you or unsafe conduct within your control, I will explain the circumstances and assess any retained payments fairly under that section.

10. Wardrobe, styling and creative work

Wardrobe access and creative planning are included only where stated in your accepted quote. Access to the existing client wardrobe does not automatically include making or buying a bespoke outfit, hiring additional items, props or specialist costume commissions.

We will discuss suitable items, fit and practical considerations. Please use borrowed items responsibly and tell me about any accidental damage promptly. You may be responsible for reasonable repair or replacement costs caused by misuse or a failure to take reasonable care, allowing for the item’s condition and age. I will not charge for ordinary wear.

11. Gallery, selection and editing

I will curate the gallery and provide the viewing or ordering arrangements agreed with you. You can choose your session’s included images and decide whether to purchase additional digital photographs or artwork.

A viewing or ordering appointment is not an obligation to purchase optional products. I will confirm editing and delivery estimates with you.

Full editing and retouching of your chosen photographs will only begin once you have completed your final image selections and confirmed by both email and WhatsApp that those selections are final and ready for editing. Saving or selecting favourites in your gallery alone does not count as this confirmation.

The editing turnaround period I confirm for your order starts once I have received both notifications and any payment due for that order. A delay in confirming your selections will therefore delay the start of editing and the delivery of your finished photographs.

I select and edit images in my established style. RAW files, rejected images and unfinished working files are not included unless expressly agreed.

Standard retouching includes light blemish and stray-hair removal. More complex requests, such as substantial object removal or alterations to appearance, may cost £50 per hour for the work required on each image. I will explain and obtain your agreement to the charge before starting additional work.

I may decline an edit outside my style or practical capability. I will not remove agreed services or charge for correcting a failure to deliver what was promised.

12. Prints, frames, albums and additional orders

I will confirm the selected products, photograph sizes, quantities, finishes, digital entitlements and total price before an order is placed.

Quoted print dimensions refer to the photograph unless stated otherwise. Mounts and frames increase the finished outer dimensions, which I will confirm where relevant before ordering.

Under my existing individual-print offer, print orders include a digital copy of the ordered photograph suitable for printing at the ordered image size, together with a social-media copy, unless a different inclusion is expressly agreed before the order. Digital entitlements for albums and collections are set out in their accepted descriptions or quote.

You will review album designs before production. I will identify any additional design or revision charges before you agree to them.

Printed products are normally delivered within two to four weeks of full payment and any required design approval, subject to the estimate confirmed for your order. If there is a delay, I will keep you informed and agree an appropriate way forward.

Custom products are made to your approved specifications. Changes after approval may involve additional costs or may no longer be possible; I will explain before agreeing changes. This does not affect your rights where an item is faulty, damaged, incorrectly supplied or not as described.

Screen and print colours may differ because of displays and printing materials. I will provide goods that match their agreed description and meet the standards required by law. Care guidance does not exclude responsibility for defects.

13. Copyright and your personal-use licence

Copyright remains with Flo Knoyle or the relevant copyright owner identified in your booking information. Purchasing a photograph or product does not transfer copyright.

For digital photographs supplied for personal use, I grant you permission to download, back up, display and share them privately and on your personal social-media accounts. High-resolution files may be printed for your own non-commercial use and personal gifts.

Commercial use, advertising, resale, stock-library submission, commercial publication or licensing to others requires separate written permission.

Please do not crop, substantially edit, apply filters to, or remove watermarks from supplied images without permission. If a social-media format requires cropping, please ask me for a suitable version.

Please credit Flo Knoyle Photography when sharing publicly where reasonably practical. A copyright dispute does not permit arbitrary withdrawal of rights you have already paid for or removal of statutory rights.

14. Model release and permission to publish images

Subject to the privacy and data-protection provisions below, you grant me permission to use, reproduce, edit, display and publish photographs and video created during your session that feature you, your horse or your property.

This permission covers my portfolio, website, social media, advertising and marketing, editorial publications, exhibitions, photographic competitions and educational materials. Images may be used in digital or printed form, worldwide, without an additional fee or royalty payable to you. I may continue these permitted uses after your booking has ended, subject to your legal rights and any written restrictions we have agreed.

I may crop, resize and edit images in my photographic style for these purposes. I do not need to obtain further approval for each individual use falling within the permission lawfully granted.

You can grant permission only for yourself and matters within your authority. Each other identifiable adult must provide their own permission where required. A parent or legal guardian must provide any required permission for a child’s images.

I will exercise these publication rights in accordance with applicable privacy and data-protection law and my privacy notice. A contractual image-use permission is not, by itself, a lawful basis for every use of personal data. Where I rely on consent, I will obtain valid consent separately and you may withdraw it for future use by contacting flo@thehorsephotographer.co.uk. Where another lawful basis applies, I will explain it and respect any applicable rights of objection.

15. Image storage and backups

I retain ordered images for one year from the session date as part of my normal storage arrangements. Unordered images may be deleted after one year. I will tell you about any specific gallery access or download deadline.

Please download delivered files promptly and keep more than one backup. A gallery or download link is not an indefinite backup service. I cannot be responsible for a failure of your own devices or storage, but remain responsible for my own contractual obligations.

If files are lost or damaged before I have fulfilled the agreement, I will discuss appropriate remedies, including replacement, a reshoot or a refund where applicable. This does not limit your statutory rights.

16. Concerns and the existing reshoot policy

Please email me promptly if something is wrong with your photographs, service or products, explaining the problem so I can investigate and respond.

My existing satisfaction policy offers one complimentary reshoot where you are completely dissatisfied with the session results. If you choose this option, final image selections are made from the replacement session. If you remain dissatisfied after that reshoot, I will refund the monies paid for that portrait booking and the licence to use refunded images will end. Copyright remains with the copyright owner.

This voluntary policy is additional to your legal rights. I will not require a reshoot where the law entitles you to a different remedy, or use it to delay a refund or other remedy you are legally entitled to receive.

Please report damaged or defective products as soon as reasonably possible. I will arrange the repair, replacement, refund or other remedy required in the circumstances. A short reporting request does not remove a longer statutory right.

17. Statutory cancellation rights

If you book or order online, by email, telephone or away from my business premises, statutory cancellation rights may apply. I will provide the cancellation information relevant to your particular contract before you commit.

Where the statutory service cancellation right applies, you may cancel without giving a reason within 14 days after the day the contract is made, by sending a clear statement to flo@thehorsephotographer.co.uk or the postal address in section 1.

If you expressly ask me to start a service during that period and then cancel, I may charge only the proportionate amount the law allows for work supplied. You lose that service cancellation right following full performance only where the required prior request and acknowledgement have been obtained. I will not treat paying a deposit alone as that request.

Different rules can apply to clearly personalised goods, digital content and qualifying date-specific leisure services. I will not assume that every photography booking is exempt merely because a date has been chosen. Any applicable exception and any required consent will be explained before purchase.

Where a statutory cancellation requires a refund, I will make it within the applicable legal period and by the original payment method unless you agree otherwise. The ordinary cancellation and deposit provisions do not override this section.

You can use the following cancellation form, but do not have to:

To: Flo Knoyle Photography Limited, 15 Woodburn Road, Stoke-on-Trent, ST6 8GB; flo@thehorsephotographer.co.uk
I give notice that I cancel my contract for the following goods or services:
Booking/order reference and description:
Date ordered or booked:
Your name:
Your address:
Date:
Signature, only if sending this on paper:

18. Liability and consumer rights

I am responsible for providing the agreed services with reasonable care and skill and for losses caused by my breach that were reasonably foreseeable when we made the contract.

Horses and outdoor locations carry inherent risks, but acknowledging those risks does not waive liability I cannot lawfully exclude.

Nothing in these terms excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.

If you are a consumer, nothing here removes your rights in relation to services, digital content or goods that are faulty, not as described or otherwise fail to meet legal requirements.

19. Website use, privacy and third-party services

My website is hosted on Wix. I also use third-party services for forms, communications, galleries and payments as described in my privacy information and relevant booking communications.

Please use the website lawfully and do not attempt unauthorised access, introduce malicious software, infringe rights or submit abusive or knowingly misleading material.

Website photographs, text and designs are protected by intellectual-property rights. You may view them for personal information, but must not copy or commercially exploit them without the relevant permission.

I aim to keep information accurate. If I identify an important error before accepting an order, I will explain it and allow you to decide whether to proceed. I will not use a general errors clause to change an accepted booking unilaterally or avoid my obligations.

External links have their own terms. Referring you to a third-party service does not remove my responsibility for the photography service I have agreed to supply.

I handle personal information in accordance with my privacy notice at https://www.thehorsephotographer.co.uk/privacy-policy. An enquiry does not automatically subscribe you to marketing.

20. Changes, complaints and applicable law

Changes to a confirmed booking must be agreed in writing, including email. Updated website terms apply to future agreements and do not automatically replace terms already agreed with you.

If a problem arises, please contact me first at flo@thehorsephotographer.co.uk so I can try to resolve it. I will provide any information about dispute-resolution arrangements that I am required to supply.

These terms are governed by the law of England and Wales. If you are a consumer, this does not deprive you of mandatory protections or rights to bring proceedings in courts available to you under applicable law.

If part of these terms is unenforceable, the remaining provisions continue so far as they can lawfully do so. Nothing requires an unfair provision to be interpreted against your statutory rights.
